RentABayNC: Assumption of Risk, Release, and Indemnity Agreement
Read this carefully. It affects your legal rights. It asks you to give up claims you might otherwise have, including claims for injuries caused by our ordinary negligence.
This agreement is between you and:
- River Rat Enterprises Inc, doing business as RentABayNC (the "Shop"), located at 668 Smithtown Rd, Grimesland, NC 27837; and
- CTE Digital LLC, doing business as CTE Studios, which provides the booking platform (the "Platform").
"We", "us" and "Releasees" mean the Shop, the Platform, and each of their owners, officers, directors, employees, agents, contractors, and the owners and landlords of the property. "You" means the person signing.
1. What we provide, and what we do not
We rent you a work bay with equipment (lift, compressor and air hoses, jack stands, lighting and power) so you can work on your own vehicle. The Shop's staff are on site, but we do not supervise, direct, inspect, or approve your work. We do not repair your vehicle, and nothing we say is mechanic's advice. If we show you how a piece of equipment works, that is a safety orientation only.
2. The risks
Working on vehicles is dangerous. Risks include, but are not limited to: a vehicle or part falling off or slipping from a lift, jack or stand; crushing, pinning or being struck; cuts, burns and scalds from hot parts and fluids; fire and explosion from fuel, vapors, batteries or sparks; breathing exhaust, carbon monoxide, dust or chemicals; slipping on spills or tripping on hoses and tools; compressed air and flying debris; eye, hearing and back injury; electric shock; hazards created by other customers, their vehicles and their work; and damage to your vehicle, tools or belongings. These risks can cause serious injury, permanent disability, or death. Not every risk can be listed here.
3. You accept the risks
You are an adult. You understand the risks and choose to take part. You agree to assume all risks of working in the Shop and of using the bay, lift and equipment, including risks that come from our ordinary negligence.
4. Release of claims
To the fullest extent the law of North Carolina allows, you release and forever give up all claims against the Releasees for injury, illness, death, or loss or damage to property (including your vehicle and everything in it) arising from your use of the bay, equipment or premises, or from work you or anyone with you does, even if the claim is caused by the ordinary negligence of a Releasee. This release does not cover gross negligence or willful or intentional misconduct, to the extent the law does not allow it to be released.
5. You keep control of your vehicle
You keep possession and control of your vehicle and belongings at all times, including if you leave them at the Shop overnight, on a weekend pass or monthly rental, or in the lot. We are not holding your vehicle for safekeeping, and storing it here is at your own risk. You are responsible for locking it and removing valuables. This does not limit our responsibility for our own gross negligence or willful acts.
6. You agree to pay for what you damage, and to defend us
You are responsible for damage you or your helpers cause to the Shop's building, equipment or other people's property. You agree to indemnify and hold harmless the Releasees (this means: pay for our losses, including reasonable legal fees) from any claim brought by you, your helpers, passengers, family, heirs or insurer, or by anyone else, that arises from your work, your vehicle, your helpers or your breach of this agreement. This does not apply to claims caused by a Releasee's gross negligence or willful misconduct.
7. Rules you will follow
You agree to follow the posted Shop Rules and the instructions of Shop staff, including:
- Use a lift only after the Shop's lift orientation. Always support a raised vehicle with stands or lift locks before you go under it.
- Work only on your own vehicle (or one you have written permission from its owner to work on). No work for pay, no repair business, no work on vehicles for others.
- Do not work under the influence of alcohol, drugs or any medication that impairs you.
- Do not do restricted work (welding, cutting or grinding with sparks, painting or body filler work, high-voltage hybrid or electric system work, airbag handling, refrigerant venting, and anything else posted) and do not use equipment you have not been shown. The tire machine, wheel balancer and A/C machine are not available to customers.
- Keep fluids out of the floor and ground; use the marked containers; clean your bay before you leave.
- Anyone who enters the work area signs this agreement first. People who only wait stay in the customer area. No one under 18 in the work area.
The Shop may stop your work, move you, or end your rental immediately if it believes you are unsafe or breaking the rules, with no refund.
8. Your health and emergencies
You confirm you are physically able to do the work. If you or a helper is hurt, Shop staff may call 911, and you are responsible for the cost of any medical care or transport.
9. Photos and cameras
The Shop uses video cameras (no audio) on the premises for safety and security. The Shop may photograph your vehicle and bay at check-in and check-out to record condition. We will not use your photos or image in advertising.
10. Your vehicle and information
You confirm you own the vehicle you bring, or have the owner's permission, and that the information you give us is true. You agree we can keep your signed copy and booking records electronically.
11. Other terms
- Governing law and court. North Carolina law governs. Any court case must be brought in Pitt County, North Carolina.
- If part of this is not enforceable, the rest stays in effect, and the unenforceable part is changed only as much as needed.
- How long it lasts. This agreement covers every visit you make in the 12 months after you sign (or until we change it and ask you to sign again), including rentals by the hour, day, weekend pass or month, and Monday to Wednesday arrangements.
- Electronic signature. You agree your electronic signature has the same effect as a handwritten one.
- This is the whole agreement about these subjects. A person who is not a party to it can only enforce it if they are a Releasee.
